Note:
Colorado does have a "Romeo and Juliet" law, which provides close-in-age exemptions for consensual sexual activity between minors and older individuals. Here are the key points:
Close-In-Age Exemptions
-
Minors Under 15: Can have consensual sex with partners who are less than four years older.
-
Minors Aged 15 or 16: Can have consensual sex with partners who are less than 10 years older.
Important Notes
-
Consent: The law applies only when the sexual activity is consensual.
-
Position of Trust: The older individual cannot be in a position of trust or authority over the minor.
-
Marriage: The law does not specifically address marriage, but the general marriage requirements still apply, such as both parties being at least 18 years old or having parental consent if under 18.
In Colorado, if you're under 18 years old and wish to get married, you'll need parental consent. Here are the specific requirements:
Parental Consent Requirements
-
Ages 16 and 17: You must have consent from both parents, a parent with legal custody, or a legal guardian.
-
Under 16: You need the same consent as above, plus judicial approval.
Judicial Approval
For those under 16, judicial approval is required in addition to parental consent. The court evaluates factors such as maturity, the nature of the relationship, and reasons for marriage to ensure it's in the minor's best interest
